SMS Messaging Terms & Compliance
These SMS terms govern the text messages Florida Aire sends to customers who have asked to receive them. They are part of, and should be read together with, the general website terms further down this page and our Privacy Policy.
01Program Description
This messaging program sends service and appointment-related text messages to customers who have booked or requested HVAC service from Florida Aire through our website at florida-aire.com, through our scheduling forms, or by phone, and who have explicitly opted in to receive SMS notifications.
Messages you may receive include:
- Appointment confirmations and scheduling details
- Appointment reminders and technician arrival-window updates
- Rescheduling, delay, and dispatch notifications
- Quote and estimate follow-ups related to a request you submitted
- Replies from our team to questions you send us, and general customer support
Message frequency varies based on your service activity and appointment schedule. A typical service visit generates roughly 2–5 messages. We do not send recurring marketing or promotional text campaigns under this program.
02Consent & Opt-In
Opt-in is collected through our web forms using a dedicated, unchecked SMS consent checkbox, or verbally during a phone call in which you ask us to text you. We keep a timestamped record of every opt-in. You will only receive text messages if you have affirmatively opted in.
Consent is not a condition of purchase. You do not have to agree to receive text messages in order to book, buy, or receive any Florida Aire service. You can always reach us, and we can always reach you, by phone at 239-223-5506 or by email at hunter@florida-aire.com instead.
03Cancellation Instructions
You can cancel the SMS service at any time. Simply text STOP to the same number that sent you messages. Upon sending STOP, we will confirm your unsubscribe status via a single final SMS containing no promotional content. Following that confirmation, you will no longer receive SMS messages from us. Opt-out requests are processed immediately. To rejoin, reply START to the number that messaged you, or sign up again as you did initially, and we will resume sending SMS messages to you.
You may also revoke your consent by any other reasonable means — for example by replying “stop texting me,” “unsubscribe,” or “remove me,” by calling 239-223-5506, or by emailing hunter@florida-aire.com. We honor every such request regardless of the wording used, and process it immediately and in no case later than 10 business days.

If you experience any issues with the messaging program, reply with the keyword HELP for assistance, or reach out directly to hunter@florida-aire.com or call 239-223-5506. Our team is available during business hours, and 24/7 for HVAC emergencies.
05Carrier Liability
Carriers are not liable for delayed or undelivered messages.
06Message & Data Rates
Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage and appointment schedule. For questions about your text plan or data plan, contact your wireless provider.
07Supported Carriers
Our SMS program is supported on the major U.S. wireless carriers, including AT&T, T-Mobile, and Verizon, as well as most regional carriers. Delivery on some regional carriers and mobile virtual network operators may vary.
08Age Restriction
You must be 18 years or older to participate in our SMS program.
09Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors that provide support services, such as customer service, is permitted. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), the Florida Telephone Solicitation Act, and CTIA guidelines, regarding the use of SMS communications.
General Terms
This website (the “Site”) is owned and operated by Florida Aire (“COMPANY,” “we” or “us”). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy, and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from Florida Aire.
Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.
We reserve the right to change these Terms of Service or to impose new conditions on the use of the Site from time to time, in which case we will post the revised Terms of Service on this website. Online Commerce

Your participation in any dealings with third-party vendors is solely between you and the third party. Florida Aire shall not be responsible for any loss or damage incurred as a result of such dealings.
Registration & Passwords
To access certain features of the Site, you may be required to register and create an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.
If you suspect unauthorized use of your account, notify us immediately at hunter@florida-aire.com. We are not liable for any loss or damage arising from your failure to comply with this obligation.
Termination
We reserve the right to terminate or suspend your access to the Site, without notice, if we determine that you have violated these Terms of Service or engaged in conduct that we deem inappropriate or unlawful. Upon termination, you must cease all use of the Site and any content obtained from it.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved exclusively through binding arbitration seated in Lee County, Florida.
